Terms of Use

1. Acceptance of Terms

By downloading, accessing, or using the VitaSum mobile application, you agree to be bound by these Terms of Use and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the app.

These Terms constitute a legally binding agreement between you and VitaSum LLC ("VitaSum," "we," "our," "us").


2. Description of Service

VitaSum provides a mobile application that allows users to:

  • Scan dietary supplement barcodes using your device camera
  • Track and log daily supplement and nutrient intake
  • Aggregate nutrient data across multiple supplements
  • Generate clinical-style nutrient summary reports
  • Share reports with healthcare providers via FHIR push, email PDF, or downloadable PDF
  • Access AI-powered responses to supplement and nutrition questions via Ask VitaSum

VitaSum is a supplement-tracking tool only. It does not cover prescription medications, general diet, or clinical nutrition unless entered manually by the user.


3. Medical Disclaimer

VitaSum is not a medical device and is not regulated as one. Nothing in the app constitutes medical advice, diagnosis, or treatment.

  • The app and all content are for informational and personal tracking purposes only
  • VitaSum does not diagnose, treat, cure, or prevent any medical condition
  • AI-generated responses may be incomplete, inaccurate, or outdated
  • Nutrient data is derived from third-party product databases and may not reflect actual product formulations

You must consult a qualified healthcare professional before making any decisions about your health, supplements, or medications. Do not disregard or delay seeking professional advice based on anything you read or generate in this app.


4. Eligibility

To create a VitaSum account, you must be at least 18 years of age, or the legal age of majority in your jurisdiction if higher.

Minors may not create their own VitaSum accounts. Supplement data for a minor family member may only be entered and managed by a parent or legal guardian acting as a Family Manager under a family account. See Section 5 (Family Accounts) for full details.

By creating an account, you represent and warrant that you meet the eligibility requirements above and that all information you provide is accurate and complete.


5. Family Accounts

VitaSum allows eligible account holders (each, a "Family Manager") to create and manage supplement profiles for other individuals, including minor children.

Family Manager Responsibilities

  • The Family Manager must be at least 18 years of age and must agree to these Terms on behalf of the family account as a whole.
  • The Family Manager is solely responsible for all activity within profiles they manage, including the accuracy of data entered for family members.
  • By creating a profile for a minor, the Family Manager represents that they are the parent or legal guardian of that individual and consents to the collection and use of that minor's data as described in our Privacy Policy.
  • The Family Manager is responsible for ensuring that any report shared on behalf of a family member is shared only with an appropriate, authorized healthcare provider.

Data and Account Control

  • The Family Manager holds full control over all profiles within their family account, including the right to access, edit, export, and delete data.
  • Deletion of the family account will result in permanent deletion of all associated family member profiles and data.

If you believe a profile has been created for you without your knowledge or consent, contact us immediately at hello@vitasum.health.


6. Camera Access

VitaSum requires access to your device's camera solely to scan dietary supplement barcodes. By granting camera permission, you authorize VitaSum to activate the camera for this purpose only.

  • The camera is activated only when you initiate a barcode scan within the app
  • No images or video are captured, stored, or transmitted by VitaSum
  • Camera access is never used in the background

You may revoke camera permission at any time through your device settings. Revoking access disables barcode scanning but does not affect other app functionality. Camera access is not required to use manually entered supplement data.


7. User Responsibilities

You agree to use VitaSum only for lawful purposes and in accordance with these Terms. You agree that you will not:

  • Provide false, misleading, or inaccurate information in your account or supplement logs
  • Attempt to hack, reverse engineer, decompile, or disassemble any part of the app or its underlying systems
  • Use the app in any way that could damage, disable, or impair its infrastructure
  • Attempt to gain unauthorized access to any system, account, or data
  • Use automated tools, bots, or scrapers to interact with the app
  • Use the app for any commercial purpose without our prior written consent
  • Violate any applicable local, state, national, or international law or regulation

8. Subscriptions and Payments

8.1 Billing

VitaSum subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform. Subscription management and billing infrastructure is provided by RevenueCat. All payments are processed by Apple or Google directly; VitaSum does not collect or store payment card information.

8.2 Auto-Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription through your Apple or Google account settings at any time.

8.3 Price Changes

We reserve the right to change subscription pricing. We will provide reasonable advance notice of any price change through the app or by email. Continued use of VitaSum after a price change takes effect constitutes your acceptance of the new pricing.

8.4 Refunds

All refund requests are governed by the refund policies of the Apple App Store or Google Play Store, as applicable. VitaSum does not process refunds directly. Please contact Apple or Google support to request a refund.


9. AI-Powered Features (Ask VitaSum)

VitaSum includes an AI-powered feature called Ask VitaSum, which allows you to submit natural-language questions about your supplement data and receive informational responses.

Third-Party AI Processing

Ask VitaSum is powered by the Anthropic API. By using Ask VitaSum, you consent to your queries and relevant nutrient context being transmitted to Anthropic's servers for processing. Anthropic processes this data in accordance with their own privacy and usage policies. VitaSum does not use your queries to train AI models.

Limitations of AI Outputs

  • AI-generated responses may be incomplete, inaccurate, or out of date
  • Responses are not a substitute for advice from a qualified healthcare professional
  • VitaSum makes no warranty regarding the accuracy or reliability of AI outputs
  • You assume full responsibility for any decisions made in reliance on AI-generated content

10. Healthcare Provider Report Sharing

VitaSum enables you to share nutrient summary reports with healthcare providers. All sharing is voluntary and user-initiated. VitaSum never shares your health data with providers automatically or without your explicit action.

User Responsibility for Sharing

  • You are solely responsible for selecting the correct recipient when sharing a report
  • Once a report is sent or downloaded, VitaSum has no control over how it is stored, used, or further shared by the recipient
  • VitaSum is not liable for any consequences arising from a report being sent to an incorrect or unintended recipient
  • When using FHIR Push, you are responsible for ensuring the endpoint you connect to belongs to your intended provider

Sharing a report with a healthcare provider does not create a patient-provider relationship with VitaSum, and VitaSum assumes no liability for clinical decisions made by any provider based on shared reports.


11. Intellectual Property

All content, software, trademarks, branding, and other intellectual property in the VitaSum app and on its associated website are owned by VitaSum LLC or its licensors and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from any part of the app or its content without our prior written permission.

Nothing in these Terms grants you any ownership rights in VitaSum or its intellectual property. Your right to use the app is a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use only.


12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VITASUM AND ITS SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

We expressly disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any warranty that the app will be uninterrupted, error-free, or free of harmful components
  • Any warranty regarding the accuracy, completeness, or reliability of supplement data, nutrient calculations, or AI-generated content
  • Any warranty that the app will meet your specific requirements or expectations

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in full.


13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VITASUM LLC OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

  • Indirect, incidental, consequential, special, or punitive damages
  • Damages arising from health decisions made in reliance on app content or AI outputs
  • Damages from incorrect, incomplete, or outdated supplement or nutrient data
  • Damages arising from supplement misuse or adverse reactions
  • Damages from service interruptions, data loss, or unauthorized access
  • Damages arising from the content of a report received by a healthcare provider

Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of VitaSum shall not exceed the greater of: (a) the amount you paid to VitaSum in the twelve months preceding the claim, or (b) $100 USD.

Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you in full.


14. Indemnification

You agree to defend, indemnify, and hold harmless VitaSum LLC, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the app or violation of these Terms
  • Your provision of inaccurate or false information
  • Your sharing of a report with any third party, including healthcare providers
  • Any claim by a third party arising from data you entered or actions you took within a family account
  • Your violation of any applicable law or third-party rights

15. Termination

We may suspend or permanently terminate your access to VitaSum at any time, with or without notice, if:

  • You violate these Terms or our Privacy Policy
  • You misuse or abuse the service or any of its features
  • We are required to do so by law or legal process
  • We discontinue the app or any portion of it

Upon termination, your right to use the app immediately ceases. Sections of these Terms that by their nature should survive termination (including the Medical Disclaimer, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law sections) will continue to apply.


16. Dispute Resolution

16.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to contact us at hello@vitasum.health and provide a written description of the dispute. We will attempt to resolve the dispute informally within 30 days of receiving your notice.

16.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or your use of VitaSum shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), rather than in court.

  • Arbitration will be conducted in Maricopa County, Arizona, or virtually by mutual agreement
  • The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction
  • You waive any right to participate in a class action lawsuit or class-wide arbitration

16.3 Exceptions

Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent imminent harm, without waiving the right to arbitration for the underlying dispute.


17. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law principles.

For any matter not subject to arbitration under Section 16, you consent to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.


18. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable or severed if modification is not possible. The remaining provisions of these Terms will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VitaSum regarding your use of the app and supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.


19. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email before they take effect. The effective date at the top of this document will always reflect the date of the most recent update.

Continued use of VitaSum after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the app.
